PERSONAL INFORMATION COLLECTION STATEMENT (PICS)
This statement applies to all personal data as defined in the Personal Data (Privacy) Ordinance (“the Ordinance”) which Transport Department of the Government of the Hong Kong Special Administrative Region of the People’s Republic of China and Toll Service Provider (“TSP”) may collect from you.
Collection of Personal Data
Your personal data will be collected from you (i) when you use the HKeToll, (ii) in the communications between you and our staff or customer service hotlines provided by Toll Service Provider (“TSP’) under HKeToll, (iii) through the forms you may completed and submit for the services provided by TSP under HKeToll from time to time and (iv) by means of the website and mobile applications maintained for HKeToll.
It is obligatory for you to supply the personal data as required from time to time. If you do not wish to provide such information, we will not be able to process your application and will not be able to provide the required service to you.
Personal data will also be collected by us from time to time after your application for services has been accepted through our supply of services to you and through our dealings and transactions with you. Furthermore, when your vehicle regardless affixed with the Toll Tag or without the Toll Tag passes through our toll points and other specific locations that have implemented with HKeToll, the data stored in your toll tag, the vehicle registration mark and the relevant time of passage will also be collected by us through our system provided under HKeToll.
We will also record by camera the vehicle passage (including the licence plate of such vehicle) through toll points at control area and government tolled tunnels that have implemented with HKeToll. Furthermore, telephone calls between you and our customer service hotlines or staff and other communications between you and our staff may be recorded.
We will also use your data collected from Transport Department for the purposes of processing of your application for Vehicle Tag, issuance of toll payment notification to you and execution of its statutory duties in traffic and transport matters.
Use of Data
Your personal data may be used for the following purposes:
processing your applications to, operating and managing the HKeToll services (including but not limited to processing your application for Toll Tag, your registration of the HKeToll Account, set-up of payment means for settlement of toll and top-up of designated stored value account, redemption of designated stored value account, termination of HKeToll Account, dispute and refund of tolls, transactions, notifications, reminder for unpaid Tolls and Surcharge, etc.) and such other services of TSP which you may subscribe from time to time;
handling and following up your enquiries, suggestions, and complaints;
investigation of the dispute transactions, non-settlement of toll transactions;
inspection of the Toll Tags;
conducting service surveys to better understand your characteristics to improve and enhance our services to you and to design and develop new services for you;
enforcement actions;
prevention or detection of crime;
communicating with you;
research or survey and as data for planning for transport or toll related services, e.g. real time traffic information system; journey time information system; speed map panel, operated by us and other Government contractor provided that all data to be provided to third parties for these purposes will be masked so it cannot be traced back to you or be used to identify you.
Furthermore, recordings of telephone conversations between you and our customer service hotlines or staff may be used for quality control, staff appraisal, and training.
Transfer of Data
Your personal data collected by us will be kept confidential and other than the parties as set out below will not be disclosed by us to any other third party. Your personal data will be disclosed to the following parties:
any actual or proposed assignee of our operation of providing the services to which you have subscribed;
any person to whom we are compelled to make disclosure under the requirements of any applicable law;
any person with your express consent;
any data processor (e.g. printer, production house or providers of mailing services) engaged by us to process or handle personal data on our behalf;
any agents or contractors who provide administrative, customer service hotlines, telecommunications, computer, payment, data processing or other services to us in connection with the operation of HKeToll on our behalf;
relevant Government departments, bureaux and relevant organizations for the aforementioned purposes under Use of Data and the activities relating to traffic and transport matters;
transaction records and evidence records including image and footage of your vehicle (including the licence plate of such vehicle) passing through toll points of control area and government tolled tunnels that have implemented with may be passed to the relevant toll road or tunnel operator or related Government body for the purpose of dealing with disputed / non-settled / toll transactions, inspection of Toll Tag and for law enforcement action.
Rights of Access and Correction to Data Collected
You have a right of access and correction with respect to personal data as provided for in sections 18 and 22 and principle 6 of Schedule 1 of the Personal Data (Privacy) Ordinance.

Data Security
All your personal data in our possession are accessible only to our authorized employees and contractors. We have also employed advance technology to ensure that data about you cannot be accessed by unauthorized persons.
